Og kan hjelpe meg med å finne betydningen av "bailment"? Er det en kausjonskontrakt?

Angående kontrakter og kontraktsbrudd; ved brudd av en "bailment" så kan den som leverer varen/tjenesten beholde noe tilhørende den som kjøper som "lien" (sikkerhet?) til varen/tjenesten er betalt for.

Bailment og lien anyone?

Bailment - Bailment results when a bailee is in lawful possession of goods but does not have title. The bailee generally has a duty to exercises ordinary care toward the goods.

bailment

n. 1) the act of placing property in the custody and control of another, usually by agreement in which the holder (bailee) is responsible for the safekeeping and return of the property. Examples: bonds left with the bank, autos parked in a garage, animals lodged with a kennel, or a storage facility (as long as the goods can be moved and are under the control of the custodian). While most are "bailments for hire" in which the custodian (bailee) is paid, there is also "constructive bailment" when the circumstances create an obligation upon the custodian to protect the goods, and "gratuitous bailment" in which there is no payment, but the bailee is still responsible, such as when a finder of a lost diamond ring places it with a custodian pending finding the owner. 2) the goods themselves which are held by a bailee. Thus, the "bailor" (owner) leaves the "bailment" (goods) with the "bailee" (custodian), and the entire transaction is a "bailment."

lien

n. any official claim or charge against property or funds for payment of a debt or an amount owed for services rendered. A lien is usually a formal document signed by the party to whom money is owed and sometimes by the debtor who agrees to the amount due. A lien carries with it the right to sell property, if necessary, to obtain the money. A mortgage or a deed of trust is a form of lien, and any lien against real property must be recorded with the County Recorder to be enforceable, including an abstract of judgment which turns a judgment into a lien against the judgment debtor's property. There are numerous types of liens including: a mechanic's lien against the real property upon which a workman, contractor or supplier has provided work or materials, an attorney's lien for fees to be paid from funds recovered by his/her efforts, a medical lien for medical bills to be paid from funds recovered for an injury, a landlord's lien against a tenant's property for unpaid rent or damages, a tax lien to enforce the government's claim of unpaid taxes, or the security agreement (UCC-1) authorized by the Uniform Commercial Code. Most liens are enforceable in the order in which they were recorded or filed (in the case of security agreements), except tax liens, which have priority over the private citizen's claim.

Hvis noen har et godt norsk uttrykk for bailment (utover kausjon), så bare kom med det.

Bare hyggelig! Har du funnet det gode norske ordet for "lien"? Jeg har det nemlig på tunga, men det når ikke frem til hjernen. Jeg vet det imidlertid når jeg ser det, så hvis du ikke finner det kan jeg logge meg på Lovdata og sjekke.

Ved slike kontrakter har man altså retensjonsrett/tilbakeholdelsesrett som Octavia hadde funnet fram til. "Lien" blir brukt om det objektet som altså kan holdes tilbake til regningen er betalt.
